Newbury Conservation Commission (NCC)
August 8, 2016

Members Present: Katheryn Holmes, Chair; Eric Unger, Vice-Chair, Sue Russell, Bob Stewart, Members; Bill Annable, Alternate.

Russell Smith, Select Board Member was in attendance.

Ms. Holmes called the meeting to order at 7:13 p.m.

ADMINISTRATIVE

Minutes
The NCC reviewed the minutes of July 12, 2016 and made corrections. Mr. Unger made a motion to accept the minutes as corrected. Ms. Russell seconded the motion. All in favor.

Administrative Business:

  • Ms. Holmes reread a letter that she had written to Mr. Thomas Hoffmeister.  The letter read as follows:
To whom it may concern:

This will serve as a formal retraction of any statements I made at the
Town of Newbury New Hampshire Conservation Commission meeting
on September 23, 2014 regarding Thomas Hoffmeister. My comments
were not accurate and should not have been made. I have never met or
spoken with Mr. Hoffmeister. I formally apologize to Mr. Hoffmeister
both personally and in my role as Chairperson of such Commission for
my intemperate remarks and lapse in professionalism. I should have
known better.

INTENT TO CUT:

  • Miche Property – High Point Road
Mr. Smith announced that there will be a site visit to the Miche property on Tuesday, August 16 at 11:00 a.m. with the Board of Selectmen.   Ms. Holmes stated that she will be out of town, but Mr. Unger agreed to be at this site review.  Mr. Stewart stated that he will not be at the site review due to the fact that he has done work for him three years ago.  Ms. Russell stated that she will attend the site review as well.

  • Moore Property – Morse Lane
Mr. Moore received a cease and desist because the time given when the permit was approved has run out.

BUFFER ZONE CUT:

  • Kellsey/Kassman on Lakeside Road, Newbury.  Removal of one dead tree. Approved.
  • Croweley on 125, Newbury.  Application was incomplete.
  • Sadowsky on Cressy Point Bolles Road, Newbury.  Approved to take down large pine tree.
  • Marks on 225 Bay Point Road, Newbury.  Approved.
  • Ferris on 131 Grace Hill Road, Newbury.  The Code Enforcement Officer is currently working on this review.
  • Beckert on 159 Bay Point Road, Newbury.  Approved.
DES:  

Ms. Holmes reviewed the following communications from the NH Department of Environmental Services (DES):

  • Thompson – For property on 15 Edgemont Landing.  Ms. Holmes read communications from the State of NH DES Wetlands.  The communications state that this project is approved pending following certain conditions.
  • Gootkind – For property on 85 Grace Hill Road.  Ms. Holmes read a notification for the restoration of dock pilings, repairing stone steps and a bench.  
COMMUNICATIONS
None.

OLD BUSINESS

Lakes and Ponds Gathering
Ms. Holmes asked if we could postpone this meeting until October so that Ms. Russell can be present at this meeting.  The commissioners agreed.  Mr. Unger will not be available for this meeting.  Ms. Russell said that the commission should also invite Blaisdell Lake as well as Kezar lake in addition to Lake Massasecum, Lake Sunapee, Chalk Pond and Lake Todd.  Ms. Holmes thought maybe the commission should keep it small for the first year and then increase the invitees in the spring.  The final decision was to include Lake Sunapee Chalk Pond and Lake Todd.  All were in favor to hold this in October.




Fells Parking Lot Update
Ms. Holmes report that The Fells have withdrawn their application.  Mr. Smith stated that The Fells will need to receive a Special Exception with the Zoning Board.  Discussion ensued on this project.

NEW BUSINESS

Love Your Lakes Day – Ms. Holmes said that this will take place next Saturday in the Harbor.

Willow Pond Sand and Gravel – Mr. Stewart said that they are currently trying to sell their property.  He explained that he had created a plan in 2008 to build two bridges over two small streams which was completed several years ago.  He explained that he mapped out the jurisdiction and these bridges were created with no disturbance to wildlife.  Stewart said that he remembers checking with the past code enforcement officer regarding any wetland buffer issues.  An attorney working on the sale was inquiring about a conditional use permit.  The chair of the planning board was looking for guidance as to whether or not they would need a conditional use permit.  Mr. Stewart said the Planning Board is looking for a member of the NCC to give their advice as to whether a conditional use permit is needed.  Discussion ensued as to whether the conditional use permit would be needed.  The Commission decided that the Planning Board needs to formally ask the Newbury Conservation Commission to rule on this.  Ms. Holmes said the chair of the Planning Board needs to contact her to discuss this issue.  At that time, they will contact the town’s counsel.  

Mr. Smith reported that the town administrator said that a meeting does not need to be posted unless there is a quorum.  He said that the administrator also said that the code enforcement officer will be invited to the Miche property site review.

Mr. Smith also reminded everyone that Master Plan Forum #2 Saturday, August 27 at 9:00 a.m. – noon.

Ms. Holmes made a motion to adjourn the meeting. Mr. Unger seconded the motion. All in favor.

The meeting adjourned at 8:23 p.m.
